CHAPTER 13

Chapter 13 is often referred to as the "wage earner" or "personal reorganization" bankruptcy. In a Chapter 13 filing, the debtor submits a plan to the bankruptcy court to pay debts over a three to five year period. At the conclusion of the plan, most remaining debts are discharged regardless of whether they have been paid in full. Chapter 13 is often very advantageous for debtors with assets they wish to keep or large amounts of non-dischargeable debt.

For debtors with regular income, Chapter 13 offers a way to get relief from overly burdensome debt loads while still retaining major assets.
As in Chapter 7 bankruptcies, the filing of a Chapter 13 immediately stops creditors from pursuing collection of debts.
